Seeking Chance for Independent Candidates

VIVAnews - Supporters of independent presidential candidates filed a lawsuit to the Constitutional Court against Law on Presidential Elections

Today, Fadjroel Rachman and several others, through their legal advisor Taufik Basari, proposed an appeal of material test to the Constitutional Court. He viewed that the Law only stipulates political parties as the only way to determine presidential candidacy.

"The Law is still not giving any chance for independent candidates," said Taufik Basari on Thursday, Dec 11.

Taufik said that the proposal for the material test equals an appeal toward Law No.23/2003 before the Law was revised to Law No.42/2008. His party will submit proceedings from the previous meeting at the Constitutional Court as part of inseparable evidence. "At that time, we had proposed seven experts," he said.

In his appeal, articles of the Law on Presidential Elections submitted for the test include article 1 section 4, article 8, article 9 and article 13 section 1. According to Taufik, if the articles are read together, they imply that the only mechanism to propose for presidential candidacy is through political parties, i.e. the exclusive right of a party.

"It is impossible for a presidential pair not  proposed by a political party or joint political parties to pass," he said.

In addition to Fadjroel, the appeal was also proposed by Executive Director of Jurnal Perempuan Mariana Amirudin and activists of Islamic organization Muhammadiyah.
